I received an account for international conversations in the amount of about 500 UAH. From this amount of my conversations there were only 45 UAH. I refused to pay other people’s conversations, but a month later I was notified that there was an investigation into my claim, and the commission made a decision that I was obliged to pay the debt, since these calls were from my phone. What can be done in such a situation?

Decree of the KM of Ukraine from 06.08.2005. No. 720 approved the Rules for the provision and receipt of telecommunication services. Clause 184 of these Rules provides that payment of telephone conversations and other intercity telephone services is made by the subscriber within 10 days after receiving the account, but no later than the 20th day of the month, which occurs after the full estimated period. If the subscriber has not paid for the services received within the prescribed time, the operator sends him a written warning about payment for 10 days after the specified period and has the right to reduce the list or stop the provision of services (paragraph 187). Subscribers have the right to file an application to the operator and complaints on the provision and receipt of telecommunication services (paragraphs 43, 45). Based on the results of the consideration of the written application, the consumer is provided with a written response with the signature of the authorized person of the operator (paragraph 49). In fact, to prove that telephone conversations were not done by you is almost impossible. Even if you were on vacation, they will object to you that your relatives or friends could take advantage of the apartment (and most importantly, the phone). The only option when you can prove your case in court is a situation if the apartment was handed over for the signaling of the security company with which the contract was pre -drawn up and the statement is written that you will be absent at a certain time.
